TERMS & CONDITIONS FOR WEEKLY SAFARIS FOR CONSUMERS
The following terms and conditions apply to all eSled – Safari reservations provided by Aurora eMotion of Aurora Powertrains Ltd. Client accepts these terms when confirming the reservation. Aurora eMotion reserves all rights to alterations.
Programs and prices:
The programs and the prices are presented in program descriptions at Arctic SnowHotel & Glass Igloos webstore. The given prices include VAT according to the Taxation Laws and Regulations of Finland. Safaris are operated subject to prevailing weather conditions which are beyond our control. We keep the right to change the duration and program without advance notification for clients best.
Reservation and payment:
eSled – Safaris by Aurora eMotion are booked online at Arctic SnowHotel & Glass Igloos webstore. Payment options will be presented in the webstore, or in case of reservations made on the spot, during the booking process. When booking in webstore 100% of the booking value is to be paid with credit card. After the succeeded payment client will receive a confirmation.
Cancellation terms:
Total cancellation of reservation:
* More than 7 days prior start of the safari cancellation fee 20,00 eur
* 7-1 days prior start of the safari 50% of the total amount to be charged.
* Less than 24 hours prior start of the safari – 100% from the total amount to be charged.
Aurora eMotion has a right to cancel or change a reservation without notice if the reservation is not paid by the due date. In force majeure cases Aurora eMotion can cancel the reservation. In this case all payments will be refunded to the client.
For cancellations and changes, please contact info@auroraemotion.com and refer to your booking number. All cancellations and changes must be done written by e-mail within office hours in Finland. In case of questions you can also call us +358 40 540 2146.
Children:
Child prices apply to children aged 4-14 years. In snowmobile programs children less than 140 cm travels in a sleigh pulled by the guide. Children over 140 cm are allowed to sit on the snowmobile when paying the adult price. Age limit in eSled programs is 4 years. Please check the special restrictions of children participation for some of the snowmobile programs.
Pregnant women:
Aurora eMotion doesn´t recommend use of the snowmobile or sledge pulled by the snowmobile for pregnant women. Driving generates vibration depending on trail condition which can be harmful. If the programme requires special organisation (e.g. additional transport), client is responsible for the possible extra costs.
Liability insurance:
Aurora eMotion has a valid liability insurance required by Finnish law. Aurora eMotion recommends that you also take personal travel insurance.
Motor liability insurance:
We have motor insurance in all our programs with motor vehicles. Compensation for damages or injury resulting from a road accident shall be covered by the valid Motor Liability Insurance of the vehicle that caused the accident.
Snowmobiles in Safaris
Safari participants are held liable for damages caused to snowmobiles. Driver´s vehicle damage self-liability is max. 990 € per snowmobile per incident. Payment is to be paid at the spot in Aurora eMotion’s safari house by cash or credit card. The driver of the snowmobile must be at least 18 years of age and in possession of a valid driver’s license in Finland. Finnish law prohibits driving a motor vehicle in under the influence of alcohol or any other intoxicating drug. As the responsible safari organizer, Aurora eMotion reserves the right to change the routing, schedules, duration or the content of the program if necessary, due to prevailing weather conditions, safety reasons and the comfort of the participants. Aurora eMotion also reserves the right to interrupt the safari if a participant is seen as a potential danger to him/herself or to others or is in poor health. If the weather is -20C or below, Aurora eMotion reserves the right to transfer the children to venues by car in our eSled safaris.
NOTE! Take your driving license with you on the eSled safari. Police may check the validity of the license during the safari.
Other Injuries
Aurora eMotion highly recommends personal travel insurance. Aurora eMotion is not liable for any accidental damage or injury which has to be indemnified under the travel insurance of a customer. eSled – safaris can be physically demanding. If the client has illnesses or disabilities (heart disease, asthma, diabetes, epilepsy, back or hip problems etc.) that could affect client’s ability to take part in the program, or if she is pregnant, she/he should consult medical experts about her/his ability to participate in the Service in question before participating any Services. In case the client has illnesses or disability of this nature, he/she acknowledges that he/she participates in the Service at his/her own risk.
Animals
All animals used in the Services (reindeer, huskies) are well trained, but behaviour of animals can never be fully predicted. Therefore, in order to reduce risks, given safety and other instructions have to be obeyed.
Force Majeure
If a contracting party is prevented from performing under this agreement or obligations otherwise based on the agreement, because of the situation beyond their control, external factors or exceptional barrier, which cannot reasonably be expected to have taken into account (such as war, fire, natural disaster, death, public transport, air transport (does not apply to scheduling delays), payment, telecommunications or electricity supply interruption) the contracting parties obligation under the contract stops on both sides till the duration of the force majeure.
Applicable Law and Jurisdiction
These terms and conditions are governed by and construed in accordance with the Finnish Law. Any disputes to be solved primarily through negotiation, but if no agreement is reached then the dispute settled by The District Court of Lapland, Rovaniemi. The Finnish Courts shall have the exclusive jurisdiction to settle any dispute, controversy or claim related to such a demand.
Severability
In case of any part, term or provision of these terms and conditions is partly or wholly held invalid, illegal or unenforceable, the validity or enforceability of other provisions, extent part and remainder of these terms and conditions shall remain in full force and effect.
